Warranty terms

1.Warrantor, Covered Party, and Warranty Term

Concrete Technology Industries, 1014 Myrtle Street, Denham Springs, Louisiana 70726 ("CTi"), warrants that its SprayMark System materials have been manufactured without defect. This limited warranty is extended only to the CTi-authorized Dealer that has completed CTi instruction applicable to the warrantied system. The warranty period begins on the project completion date shown in the registration and continues for one year, provided every condition of this warranty has been strictly satisfied.

2.Covered Performance

Subject to all conditions and exclusions in this warranty, the SprayMark System is warrantied to:

  • Resist dramatic color fading and chalking that washes down and stains adjacent surfaces.
  • Inhibit mildew growth on the surface of the cured film. Mildew-resistant does not mean mildew-proof.
  • Resist peeling or blistering from the original, properly prepared concrete surface, excluding cracks and crack repairs.

3.General Exclusions

This limited warranty applies only to SprayMark System materials installed on interior or exterior concrete. It does not cover failure caused in whole or in part by a defective or unstable substrate; alkaline reaction; efflorescence; moisture, vapor, or water transmission; a previous coating that loses adhesion; oil, grease, rust, mildew, or other contamination; fire; hail or other acts of God; structural defects or movement; vandalism; abuse; or neglect.

4.Crack Exclusion

CRACKS ARE NOT WARRANTED: Because concrete is subject to movement from freeze/thaw cycles, heaving, settlement, hydrostatic pressure, and other conditions, CTi does not warrant cracks, cracking, or any chipping, peeling, blistering, or other failure of the SprayMark System at, over, or adjacent to an existing or future crack or crack repair, regardless of the repair method used.

5.Conditions of Coverage

Coverage applies only when all preparation and installation requirements have been strictly followed. One hundred percent (100%) of previous coatings must be removed. The concrete must be ground or pressure washed at a minimum of 3,000 psi, and all impurities and contaminants, including oil, rust, mildew, and grease, must be fully removed before installation. When pressure washing cannot be used or will not completely remove coatings or contamination, abrasion or shot-blast equipment must be used to achieve complete removal. The SprayMark System must also be installed by a CTi-authorized Dealer in accordance with CTi's written instructions and the manufacturer's criteria in effect at the time of installation.

6.Manufacturer and Independent Dealer Responsibilities

  • CTi warrants that its supplied materials were manufactured without defect.
  • The Dealer is independent and is not CTi's employee, agent, or installation entity. CTi has no ownership interest in the Dealer's business, and no Dealer or agent may alter this warranty in any way whatsoever.
  • The Dealer is responsible for using qualified personnel and for proper preparation, installation, maintenance, and any required sealer reapplication.
  • If CTi representation is requested at a project, including, but not limited to, for a warranty matter, the Dealer is responsible for CTi's reasonable time, travel, lodging, and related expenses.

7.Exclusive Remedy and Limitation of Liability

CTi's sole obligation under this limited warranty is replacement of qualifying defective CTi materials. Labor and all costs of removal, preparation, repair, reinstallation, travel, lodging, and freight are excluded. To the extent permitted by applicable law, CTi is not responsible for incidental or consequential damages. CTi makes and recognizes no warranty other than the written warranty contained in this document, and no Dealer is authorized to modify it in any way whatsoever.

Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

8.How to Make a Claim

The CTi-authorized Dealer must complete each of the following steps:

  1. Submit this warranty registration within 30 days after project completion.
  2. For a claim, provide CTi with a copy of the registered warranty, a fully completed CTi claim form, clear batch-label photos or copies, and all photographs, records, and other information CTi reasonably requests to evaluate the claim.
  3. Mail any physical samples CTi requests to Concrete Technology Industries, 1014 Myrtle Street, Denham Springs, LA 70726, identified with the assigned claim number.
  4. Allow CTi up to 90 days after receipt of a complete, valid claim to inspect, investigate, and determine whether the materials were defective.
  5. If CTi determines that qualifying materials were defective, CTi will provide replacement materials to the Dealer at no charge for the materials. Shipping will be freight collect. The Dealer remains responsible for reapplication and all related labor and costs.

9.Registration Requirement

This warranty registration must be completed and submitted by the CTi-authorized Dealer within 30 days after project completion. Failure to submit a complete registration on time or comply with any condition of this warranty makes the warranty null and void.
